Refund Policy
1. Introduction
“You” / “your” / “yours” / “customer” means a natural person who has opened an account on Omnix.exchange and has agreed to all terms and conditions of Omnix.exchange, and wants to use the Services available on the Platform. “Omnix” means Bitomni S.R.O, a limited liability company (registration No. 176 76 967) incorporated in Czech Republic, address: Chudenická 1059/30, Prague, Czech Republic 10200. “Transaction” means: 1) your purchase of cryptocurrency from Omnix.exchange; 2) sale of your cryptocurrency to Omnix. Each Transaction is a two-party transaction between you and Omnix. The list of available cryptocurrencies is present on Omnix.exchange and can be amended by Omnix without prior notice. “Services” means the services provided by Omnix: 1) selling of cryptocurrency to the customer for fiat currency; and 2) buying cryptocurrency from the customer for fiat currency. Omnix does not provide the Services to corporate customers. Omnix does not act as custodian for your funds, both crypto and fiat.
2. Main principles
While completed Transactions are irreversible, Omnix ensures that each customer has the right for refund if: 1) Omnix did not send the requested amount of cryptocurrency to the customer’s chosen cryptocurrency wallet as part of the Transaction; 2) Omnix received cryptocurrency to Omnix’s cryptocurrency wallet from the customer, but the customer did not received fiat. Please note that Transactions may require up to 5 days to be completed. The refund cannot be processed if this deadline is not expired. If the Transaction is not authorized by you, Omnix will refund you the amount of the unauthorized Transaction within 5 (five) business days if it is determined that the reason for such unauthorized Transaction’s completion is Omnix’s gross negligence or wilfull misconduct. By using the Services you confirm that Omnix is not liable for actions of third parties providing investment and financial advices to you. Omnix strongly advices you to use only cryptocurrency wallets under your direct control and not to disclose your account access and activity to third parties. Scammers tend to disguise as “brokers” who will try to steal your funds. It means you shouldn’t act under someone else’s instructions while using the Services. If you allow someone to remotely control your device or give you instructions while using the Services, you will be liable for any actions that such person take on your account on Omnix.exchange, as further set out in Section 3.2 above. The right for a refund may apply to those customers who has paid a Omnix fee, and the full sum of Transaction is received by Omnix. Omnix shall process your request for refund following receipt as soon as it is reasonably practicable. Please note that response times will vary depending on the payment method and your reason for making such request. Omnix shall notify you of the outcome of your request as soon as it is assessed by the dedicated team of Omnix. Omnix has the right to change and modify this refund policy at any time. Crucial amendments will become known to you before taking effect. 3. Payment policy
It is not possible to apply for refund if the customer is purchasing cryptocurrency, unless Omnix’s gross negligence or willful misconduct is involved. However, it is possible to initiate a new Transaction and sell Omnix the previously bought amount of cryptocurrency. Please note that for such reverse Transaction Omnix fee is applied, as well as other relevant fees. In case the customer provides false or incorrect information while initiating the Transaction (e.g. bank account number that belongs to the third person), which results in the Transaction being rejected, all fees associated with the Transaction’s refund shall be borne by the customer. The reason behind this is the fact that the cryptocurrency price is changing on an ongoing basis, which means the value of the purchased cryptocurrency at the moment of refund may change significantly. Other transactions Refunds are possible within 30 days from the moment of the Transaction. Any additional fees incurred by Omnix as a result of the refund shall be borne by the customer. Chargebacks Omnix invites its customers to contact it via e-mail if you have any issues with your payments on Omnix.exchange before making any chargeback requests. Please note that this refund policy does not affect your rights for chargeback requests that are permitted by applicable regulations. Omnix will inspect all chargeback requests and will inform relevant banks of its customer regarding the provided Services and / or particular Transactions. Omnix has the right to suspend the customer’s access to the Services during the chargeback investigation procedure.
